Terms & Conditions

Below are our active 2022/2023 Terms & Conditions

Payment

We accept payment by BACS, cheque or PayPal.

Payment Terms

Our standard payment terms require full payment within 30 days unless otherwise agreed upon in advance. The material provided will be licensed for use upon receipt of full payment. We are open to discussing these terms further and assure you that we operate with fairness, reasonableness, and transparency.

To provide an accurate quote, we require a complete briefing from the client and a discussion of the project requirements and expectations. Please note that interest will be charged for late payment of services after 30 days, in accordance with statutory regulations. For business-to-business transactions, this interest rate is 8% plus the Bank of England base rate.

Availability – Booking

Considering the unpredictable weather conditions in the UK and the specific requirements of aerial photography, we maintain a high degree of flexibility when working with clients. It is not uncommon for us to receive last-minute booking requests, and we do our best to accommodate them.

That said, we need sufficient time to conduct pre-flight checks and ensure that the project can be executed safely and in compliance with all relevant regulations and our operating license. This is critical to maintaining the highest standards of aerial filming and ensuring the safety of all parties involved.

Operational brief, permissions & site access

MSPhotographic will prepare an operational brief prior to any deployment, and a site visit may be conducted, depending on the nature of the operational requirement. However, it is the client's responsibility to ensure that all necessary permissions from the landowner have been obtained to allow for the deployment of the drone. Additionally, the client must ensure that safe access to the site is available.

In the event that access to the site is unavailable on the day of the operation, the client will be held liable for the full rate quoted, as well as any applicable expenses.

Filming

During the operation, the pilot will assume full responsibility for flying the drone safely and responsibly. If it becomes apparent that a requested elevation, angle, or speed for a filming operation would compromise operational safety, MSPhotographic will abort the flight. We will make every effort to capture images at an alternative elevation, angle, or speed, but we cannot guarantee that these will match the client's original filming request.

To avoid potential complications, it is advisable to request a site visit and hold a discussion with our team prior to operational deployment. Site visits are typically included as part of our quote, but depending on the location and urgency, there may be additional charges.

Editing

As part of our aerial video service, MSPhotographic will provide one short clip promotional edit of up to one minute in duration, specifically for use on social media. This edit will include no more than one alteration. For longer length edits intended for promotional packages, media, newsreels, website insertion, and other professional applications, we offer a dedicated professional editing service.

Postponement, cancellations & weather

The conditions for aerial filming are naturally dependent on weather and flying conditions. In the event that it is deemed unsafe to deploy the drone, the pilot(s) will not operate or land until they are satisfied that it is safe to do so.

Clients may cancel their shoot up to 4 days prior to the scheduled date without incurring any charges. If the operation cannot be rescheduled, we will work with the client to reach a fair and reasonable compromise.

If cancellation occurs less than 4 days before the shoot, a charge of 50% of the quoted price will apply.

In the event of a cancellation on the day of the shoot, full day rates, including expenses such as mileage, will apply once the pilots/operators have travelled to the location.

However, if a cancellation due to weather occurs prior to the shoot day and is rescheduled, no charges will be incurred.

If the client decides not to reschedule the shoot after advice has been given to do so by MSPhotographic, a charge of 50% of the quoted price will be levied, in addition to any additional expenses incurred such as mileage.

In the event that a drone deployment is cancelled due to reasons other than weather, and cannot be rescheduled due to the client no longer requiring our services, the client will be responsible for paying the full quoted price, including any costs that may have been incurred.
